Who we are

Trust-Deeds.co.uk is a trading style of My Debt Plan Ltd, a company registered in England and Wales (No. 10992838), Registered Address Alexandra Court, Carrs Road, Cheadle, SK8 2JY. My Debt Plan Ltd is the data controller for the personal data described in this policy and is registered with the Information Commissioner’s Office (registration no. ZB284067).

The information we collect

Depending on how you interact with us, we may collect:

• Your name and contact details (email address, telephone number, and postal address where relevant);
• Information about your financial circumstances that you choose to share — for example your approximate level of debt, what you can afford to pay each month, the number of creditors you owe, and whether you live in Scotland;
• Records of your contact with us (calls, emails and enquiry-form submissions); and
• Technical data such as your IP address and how you use this website, collected through cookies (see our Cookie Policy).

How we use your information and our lawful bases

We use your information to:

• respond to your enquiry and provide debt advice and, if you choose to proceed, the debt solution you ask us to help with — on the basis that processing is necessary to take steps at your request before entering into, and to perform, a contract, and on the basis of your consent for the initial enquiry;
• assess which debt solutions may be suitable for you — on the basis of our legitimate interests in providing a relevant service, and to perform a contract;
• meet our legal and regulatory obligations, including those of insolvency legislation — on the basis of compliance with a legal obligation; and
• keep proper business records and handle any complaints — on the basis of our legitimate interests and legal obligations.

Where we rely on your consent (for example to contact you about your enquiry), you can withdraw it at any time by contacting us.

Who we share your information with

We do not sell your personal data. We may share it with:

• our lead-management and CRM provider, which processes enquiry submissions on our behalf;
• the licensed insolvency practitioner appointed to act as your trustee, and members of our consumer debt services team;
• your creditors, the Accountant in Bankruptcy and, where relevant, the courts — where this is necessary to set up or administer a debt solution;
• credit reference and fraud prevention agencies where relevant to a debt solution; and
• professional advisers, auditors and regulators, or where we are required to do so by law.

Any third parties that process data on our behalf are required to keep it secure and to use it only for the purposes we specify.

How long we keep it

We keep your personal data only for as long as necessary for the purposes above. Where you make an enquiry but do not proceed, we keep your details for a limited period and then delete them. Where you enter into a debt solution, we keep records for as long as needed to administer it and to meet our legal, regulatory and insurance obligations — typically at least six years after our relationship ends.

Where your data is held

Your personal data is stored and processed within the UK. If any transfer outside the UK were ever necessary, we would ensure an appropriate safeguard recognised under UK data protection law is in place.

Your rights

Under UK data protection law you have the right to:

• ask for a copy of the personal data we hold about you;
• ask us to correct inaccurate or incomplete data;
• ask us to delete your data in certain circumstances;
• ask us to restrict or object to our processing in certain circumstances;
• ask us to transfer your data to another provider where applicable; and
• withdraw consent where we rely on it.

To exercise any of these rights, contact us using the details below. You also have the right to complain to the Information Commissioner’s Office (ico.org.uk) if you are unhappy with how we handle your data, although we’d welcome the chance to put things right first.
